CHELTENHAM, UK. 13th November, 2024 – In a significant High Court decision in the Intellectual Property Enterprise Court, Albright IP has successfully defended its client, Liking Ltd, against copyright infringement claims brought by WaterRower (UK) Ltd. 

The judgement has set a precedent for copyright protection of non-sculptural 3D objects, specifically addressing the criteria for “a work of artistic craftsmanship” under the Copyright, Designs and Patents Act 1988 (CDPA).

WaterRower claimed that their water-resistance rowing machines were works of artistic craftsmanship and were protected by copyright, and that our Hong Kong-based client’s Topiom rowing machines infringed on this protection by allegedly reproducing a substantial part of the machines. 

Liking Ltd argued that the WaterRower machines did not qualify as works of artistic craftsmanship and thus were ineligible for copyright protection.

In delivering his judgment, Judge Campbell Forsyth ruled that WaterRower machines, including its prototype, do not meet the requirements under UK law as works of artistic craftsmanship, and therefore, no copyright subsist in the machines. 

This judgment underscores the divergence between UK and EU interpretations of copyright law, providing greater clarity for the UK’s requirements in assessing copyright eligibility for such 3D functional objects.

Albright IP, Patent Director, Cloe Loo, who served as IP attorney for Liking Ltd, commented: “This judgment provides much-needed clarity in UK copyright law on what qualifies as a work of artistic craftsmanship. For a number of years, conflicting UK and EU case law has created uncertainty around copyright protection for 3D objects that aren’t sculptures. This ruling establishes that such objects must meet the test of artistic craftsmanship to qualify for copyright. It’s an important milestone for the IP sector.”

Loo noted that navigating the case presented unique challenges, including coordinating across multiple time zones and languages to effectively communicate complex legal arguments to her client. 

Working closely with Liking Ltd required not only a robust IP strategy but also a deep understanding of their language and business culture. Communicating the nuances of UK copyright law in Chinese, for instance, was essential to ensure our client was fully informed and comfortable with each stage of the case,” she explained.

UTAH, US. August 19th, 2024 – This election cycle has a decent number of independent and third party candidates on the ballot. What motivates a candidate to run outside the two main parties? What options exist for Utahns with the various independent and third party options?
 
On August 29 at 6:30 P.M. at the Sandy City Library, various independent and third party candidates will be present to share their vision on why options outside of the two main parties will help improve Utah and its political scene. Candidates will include those running for Governor, Attorney General, Auditor, Senate, and a variety of other offices. You can meet candidates in person, ask questions, and learn about the political realm that is becoming a growing option for improving politics in Utah.
 
“Some offices in Utah function at their best and highest levels when they are independent of the two main parties” Austin Hepworth, an independent candidate for Attorney General, stated. “The State Auditor and Attorney General should not be controlled by the party in power, as this produces conflicts of interest. Just as we do not let Wall Street audit itself, or professional sports teams select their own referees, so too should the government be subject to truly independent audits and independent officials who simply enforce the law without push or persuasion of the governing party.” Austin continues “A strong system of checks and balances helps to keep politics clean, helps with establishing trust, and makes for a better system overall. UTAH, USA. 8th August, 2024 – Independent Attorney General candidate Austin Hepworth has filed a constitutional challenge against the United States federal government. Specifically challenging the Federal Corporate Transparency Act (CTA) on behalf of small businesses in Utah and other states. The CTA, a federal law passed by Congress, imposes new compliance burdens on small businesses. 
 
Hepworth argues that the CTA violates several constitutional protections: 
 
1. Fourth Amendment: The law requires small business owners to provide information that could be used against them in law enforcement actions and shared with other countries, which Hepworth contends constitutes an unreasonable search and seizure. 
    
2. Fifth Amendment: Hepworth claims the CTA is overly vague, as it requires reporting the identities of individuals who “substantially control” a company, even indirectly. This ambiguity can lead to excessive discretion by enforcers and unclear compliance requirements. 
 
3. First Amendment: The forced disclosure of private relationships could infringe on free speech and association rights, potentially exposing individuals to legal risks based on their associations or public stances on sensitive issues. 
 
4. Tenth Amendment: Hepworth argues that business regulation should be left to the states, as the CTA oversteps federal authority by imposing uniform rules on business ownership. 
 
Hepworth likens the CTA’s requirements to a hypothetical scenario where law-abiding citizens must disclose all medicines and visitors in their homes to help identify illegal activity. He asserts that the law imposes undue burdens on small business owners, who are not responsible for law enforcement, and argues that the government’s benefit is minimal. 
 
He emphasizes the importance of constitutional protections and believes that the courts will uphold these rights, ensuring that small business owners are not unduly burdened by unconstitutional government regulations.

MCALLEN, USA, 6 February 2024 – 2023 Texas crash data has revealed that motor vehicle fatalities have fallen for the second consecutive year.
The Texas Department of Transportation (TxDOT) usually releases its Traffic Crash Facts document — compiling the previous year’s statistics on motor vehicle accidents in the state — in March.
But Texas personal injury law firm Patino Law has compiled data using TxDOT’s Crash Records Information System (C.R.I.S.) to present the latest auto accident statistics, yielding several insights.
According to C.R.I.S., 4,254 people suffered fatal injuries in Texas in 2023, down 3.5% from 4,407 in 2022.
A drop in auto accident fatalities should be a cause for celebration. It comes after the state department recently urged Texans to make safe decisions behind the wheel and outlined its plans to enhance safety on Texas roads, committing to investing $17 billion in safety improvements over the next 10 years — itself a response to the shocking fact that at least one fatality has occurred each day on Texas roads for the past 23 years.
But while fatalities have decreased, it’s clear Texas still has a long way to go.
Injuries from reportable crashes increased last year, from 248,731 in 2022 to 254,095, translating in one person being injured every two minutes and four seconds — down from two minutes and nine seconds in 2022.
Motorcyclist Deaths Increase
While total fatalities fell, motorcycle accident deaths increased in 2023, up from 562 to 595, and the data on helmet use is particularly alarming.
In 2023, 265 of the 595 motorcyclists or motorcycle passengers killed in crashes were not wearing a helmet.
But as the research shows, wearing a helmet alone is not enough to prevent a fatality.
Notably, 300 individuals who died in these crashes wore a helmet, but it was damaged. In contrast, there were just 30 deaths of motorcyclists or passengers wearing undamaged helmets.
Wearing a helmet is optional for riders aged 21 or over with medical insurance coverage and who have completed an approved motorcycle operator course. However, these statistics could not better illustrate the life-saving impact of wearing head protection on the road.
More People Injured in Crashes Involving Parties without Insurance
Patino Law Firm also explored how many fatal and serious injury crashes involved drivers without insurance, which can have a massive impact on an injury victim’s ability to recover compensation.
The number of people who sustained suspected serious injuries in crashes where at least one party had expired or insufficient proof of financial security increased in 2023, from 5,443 to 5,664.
Dr. Louis “Doc” Patino, founder of the San Antonio and McAllen-based personal injury law firm and who compiled the data, said: “It’s positive to see fatalities fall again last year. Every decrease represents a life saved and a family prevented from mourning a loved one taken far too soon. But we must not lose sight of the end goal and the part we all have to play in making Texas roads safer.”
On the increase in serious injuries sustained in auto crashes, Dr. Patino continues: “We must also not underestimate the devastating effect of serious injuries. Incapacitating injuries like traumatic brain injuries, spinal cord damage, and burns can upend a survivor’s life, leaving them with staggering medical bills, severe emotional trauma, and unable to work, and the increase in injuries sustained in crashes where those involved do not have insurance is particularly concerning, as it can make it much more difficult for them to recover the compensation they’re rightfully owed.”
Patino Law Firm’s research also delves into crashes caused by drunk driving, speeding, and driver distraction and highlights when and where the most fatal and serious injury crashes occurred in 2023 versus 2022.

LONDON, UK, 4th May 2023 – If you and your British partner are living together abroad and one day decide to set up your home in the UK, there are seven most important things you should know. 

1.       Being married to a British citizen does not give you an automatic right to live in the UK. 
 
Non visa nationals often believe that they do not need a visa to the UK. This is not quite right. As a non-visa national, you may not need a visa to travel to the UK as a tourist or for a family visit. However, to set up a home in the UK you will need a visa which will allow you to stay in the long term, take up employment or set up your business in the UK, rent accommodation, open a bank account, send children to a state funded school, and use the NHS.
 
2.       Spouse visa is not the only option you may wish to consider. 
 
Other types of visa may be a better fit for your circumstances. For example, if you have a job offer in the UK and the employer is prepared to sponsor you, the skilled worker or scale-up visa has a much shorter processing time and you may get your sooner by a few months than applying for the spouse visa. You won’t have to meet the financial requirements, but there will be a higher requirement for the knowledge of English.
 
You may also wish to check if you qualify for the Global talent visa. This visa is not only for winners of prestigious prizes and glamorous people from out of this world, but you may also qualify as a leading figure in research and academia, digital technology, or arts and culture. A prize winning photographer or lead researcher in a project with a qualifying grant may qualify for the Global talent visa. The advantage of this route is not only a much shorter processing time and no financial requirement, but also that you may qualify for indefinite leave to remain after three years of residence, and the visa fees will be much lower than the spouse visa fees.
 
3.       For the spouse visa – check if you meet the financial requirement
 
If you decide that the spouse visa is the right option for you, do not forget to check out the financial requirement. You may rely on savings for this, but if, as most of us, you have to rely on income from earnings, the British partner has to show that their earnings outside the UK are above the minimum threshold, and they have a suitable job offer in the UK with prospective salary above the minimum threshold. The non- British partner cannot rely on their earnings outside the UK or a job offer in the UK to meet the financial requirement for the spouse visa.
 
4.       Do not forget that you will need a visa extension
 
After 33 months, spouse visa has to be extended for another 2.5 years before you can apply for indefinite leave to remain. If you miss the deadline for the extension application, you may have to leave the country and apply again for entry clearance from outside the UK.
 
5.       You will be eligible to apply for indefinite leave to remain after five years of residence as a spouse. Indefinite leave to remain is not the same as British citizenship. 
 
6.       Being married to a British citizen allows you to apply for citizenship straight after your application for ILR is approved. You will have to make a separate application called application for naturalisation. After naturalisation you are entitled to apply for a British passport.
 
7.       And last but not least, don’t forget that an immigration lawyer in London is best suited to represent you in your visa application from overseas. All applications are done electronically online, and instructions from clients are taken in zoom meetings, by email and over the telephone. UK-based lawyers are regulated and you will have much better chance of success if your case is handled by an expert.
